Terms of Service

1. The agreement

These Terms of Service (“Terms”) are a binding license agreement between you and the developer of Aptosys (“Aptosys”). They cover the Aptosys Wallet app for iPhone (the “App”) and this website (together, the “Service”).

By downloading, installing, or using the Service, you agree to these Terms and to the Privacy Policy and Guidelines. If you do not agree, do not use the Service.

2. What Aptosys is and is not

Aptosys is self-custodial software. It lets you create, import, view, and use wallets on the Aptos network from this iPhone. You keep control of your private keys at all times.

Aptosys does not sell, buy, swap, exchange, lend, borrow, or stake digital assets. It does not offer fiat on-ramps or off-ramps. It is not an exchange, broker, dealer, money transmitter, payment processor, custodian, or bank. Aptosys never holds, controls, or has access to your assets.

Aptosys is not affiliated with, endorsed by, or sponsored by the Aptos Foundation or Aptos Labs.

3. Eligibility

• You must be at least 18 years old and able to form a binding contract where you live.
• You must not be located in, or a resident of, a place where using the Service is illegal.
• You must not be subject to sanctions or on any government list of prohibited or restricted parties.

4. Self-custody and your recovery phrase

• Your recovery phrase and private keys are generated and encrypted on this iPhone. They never leave it and are never sent to Aptosys.
• Aptosys cannot view, reset, or recover your recovery phrase, private keys, or passcode. If you lose your phrase, you lose your assets. No one can restore them.
• Anyone with your recovery phrase can take your assets. Aptosys will never ask for it.
• You are solely responsible for backing up your phrase, keeping it secret, and securing your device.
• Deleting the App or erasing a wallet removes it from this iPhone. Back up your phrase first.

5. Transactions and network fees

You create and sign every transaction yourself on this iPhone. Aptosys only passes your signed transaction to the public Aptos network.

• Transactions are final. They cannot be reversed, cancelled, or refunded by Aptosys or anyone else.
• You are responsible for checking every address, amount, and network (mainnet or testnet) before you send.
• Network fees are paid in APT to the Aptos network, not to Aptosys. Fees vary and are usually under a cent, but are not fixed.
• Aptosys does not control the Aptos network and is not responsible for delays, failures, forks, or changes to it.

6. Prices and information

Prices, charts, balances, and token details come from public third-party sources. They can be delayed, incomplete, or wrong. Nothing in the Service is financial, investment, legal, or tax advice. You are responsible for your own decisions and for any taxes on your activity.

7. Risks of digital assets

• Digital asset prices are volatile and can go to zero.
• Tokens may be scams, fakes, or have no value. Showing a token in the App is not an endorsement.
• Software, smart contracts, and networks can have bugs or be attacked.
• Laws about digital assets change and may affect your ability to use them.

8. Acceptable use

You agree not to:

• Use the Service for fraud, money laundering, terrorist financing, sanctions evasion, or any other illegal purpose.
• Copy, modify, reverse engineer, decompile, or create derivative works of the App, except where the law allows.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service.
• Impersonate Aptosys or use its name or mark to mislead others.

9. License

Aptosys grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The App may also be used by other accounts associated with you through Family Sharing or volume purchasing.

The App is licensed, not sold. Aptosys keeps all rights not expressly granted. The Aptosys name and mark belong to Aptosys.

10. Updates and availability

Aptosys may release updates that add, change, or remove features. Some updates may be required to keep using the App. Aptosys may stop offering the App at any time. Because your keys live on this iPhone, you can always restore your wallet in any compatible Aptos wallet using your recovery phrase.

11. Third-party services

The Service relies on third parties such as Aptos network nodes, indexers, and price providers. Aptosys does not control them and is not responsible for their content, availability, or practices. Your use of them is subject to their own terms.

12. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. Aptosys does not warrant that the Service will be secure, error-free, or uninterrupted.

13. Limitation of liability

To the maximum extent permitted by law, Aptosys is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of assets, profits, data, or goodwill. This includes losses from a lost or stolen recovery phrase, a compromised device, a mistaken transaction, a third-party service, or network events.

Aptosys's total liability for any claim is limited to the greater of the amount you paid for the App (if any) or US $50.

Some places do not allow these exclusions or limits. In those places, they apply only to the extent allowed.

14. Indemnity

To the extent permitted by law, you agree to indemnify Aptosys against claims, losses, and costs arising from your misuse of the Service or your breach of these Terms.

15. Apple App Store terms

These terms apply because you obtained the App from the Apple App Store:

• Acknowledgement. These Terms are between you and Aptosys only, not Apple. Aptosys, not Apple, is solely responsible for the App and its content. These Terms do not provide usage rules that conflict with the Apple Media Services Terms and Conditions.
• Maintenance and support. Aptosys alone is responsible for maintenance and support, as described in the Contact section. Apple has no obligation to provide any maintenance or support for the App.
• Warranty. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims, losses, or costs due to a failure to conform to a warranty are Aptosys's responsibility.
• Product claims. Aptosys, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
• Intellectual property. If a third party claims that the App or your use of it infringes their intellectual property rights, Aptosys, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
• Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party terms. You must comply with applicable third-party terms, such as your wireless data service agreement, when using the App.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

16. Termination

You may stop using the Service at any time by deleting the App. Your license ends automatically if you breach these Terms. Sections on self-custody, transactions, risks, warranties, liability, indemnity, Apple terms, and disputes survive termination.

17. Changes to these Terms

Aptosys may update these Terms. The effective date at the top will change, and material changes will be noted in the App before they take effect. Continuing to use the Service after that means you accept the updated Terms.

18. Governing law and disputes

These Terms are governed by the laws of the jurisdiction where the developer of Aptosys is established, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction, unless the law where you live gives you the right to bring a claim locally.

Before filing a claim, please contact support@aptosys.app so Aptosys can try to resolve it informally within 30 days. Nothing here limits rights you have under mandatory consumer protection law.

19. General

• Entire agreement. These Terms, the Privacy Policy, and the Guidelines are the whole agreement between you and Aptosys about the Service.
• Severability. If any part is found unenforceable, the rest stays in effect.
• No waiver. Not enforcing a term is not a waiver of it.
• Assignment. You may not transfer these Terms. Aptosys may transfer them as part of a merger or sale.
• Language. If these Terms are translated, the English version controls.
